Recruit Portal Terms of Service

These Terms of Service ("Terms") govern your use of recruit.jobads.ca (the "Recruit Portal") operated by Cicero Group Canada Software, Inc. ("we", "us", "JobAds.ca"). By creating an employer account, posting an opportunity, or otherwise using the Recruit Portal, you agree to these Terms.

1. Who can use the Recruit Portal

You must be at least 18 years old and legally authorized to represent the organization you are posting on behalf of. Individual accounts on the Recruit Portal are personal to you; do not share your login credentials.

2. Free plan and future paid plans

The Recruit Portal currently offers a Free plan that includes unlimited opportunity postings and a public branded employer page on JobAds.ca. We may introduce Business and Enterprise plans with additional features (applicant tracking, screening questions, offer letters, reports, and support) at any time. Prices, feature bundles, and inclusions of paid plans will be posted on the Recruit Portal at the time of launch and may change with notice.

3. Content you post

You are solely responsible for every opportunity, description, requisition, image, logo, and other content ("Content") you publish through the Recruit Portal. By posting Content you represent that:

You have the right to publish the Content and grant us a non-exclusive, worldwide, royalty-free license to display, index, and distribute it on JobAds.ca and its partner surfaces (search engines, social previews, syndicated feeds, etc.).
The Content describes a real, currently available opportunity at a legitimate organization, is not misleading, does not require an upfront payment from applicants, does not solicit unlawful work, and does not discriminate on any protected ground under applicable Canadian human rights law.
The Content is accurate, does not infringe third-party intellectual property, and is not spam, malware, phishing, or otherwise abusive.

4. Applicant data

When candidates apply through the Recruit Portal you receive access to information they share with your organization (name, contact info, resume, and answers to screening questions). You agree to:

Use applicant information solely to evaluate that applicant for the opportunity to which they applied;
Keep it confidential and secure using reasonable safeguards;
Comply with all applicable privacy laws including PIPEDA and any provincial equivalents;
Delete or return applicant data on request and not retain it longer than necessary.

5. Suspension and termination at our discretion. We may suspend, restrict, or terminate any employer account, remove any opportunity posting, revoke access to any part of the Recruit Portal, or refuse service to any organization at our sole discretion, at any time, with or without notice or cause. Common reasons include (but are not limited to): posting misleading or fraudulent opportunities; violating these Terms; receiving repeated candidate complaints; misusing applicant data; abusing platform resources; attempting to circumvent rate limits or moderation; failing to respond to legitimate applicants; or exhibiting patterns of low-quality activity that harm the JobAds.ca marketplace. We are not obligated to explain our reasons and are not liable to you or any third party for any losses resulting from suspension or termination. If your account is suspended, all published opportunities are immediately removed from JobAds.ca search results.

6. Fees and refunds

The Free plan is provided at no cost. For any paid plan you may subscribe to in the future, fees are charged in advance and are non-refundable except where required by law. If we suspend or terminate a paid account for cause under Section 5, no refund is owed for the unused portion of the current billing period.

7. Our services are provided "as is"

The Recruit Portal is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied. We do not warrant uninterrupted availability, that the platform will meet your requirements, or that any candidate will be found for any opportunity. To the maximum extent permitted by law, we disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of liability

To the maximum extent permitted by law, our total aggregate liability to you for any claim arising out of or related to your use of the Recruit Portal is limited to the greater of (a) $100 CAD or (b) the amount you have paid us in the 12 months preceding the claim. In no event will we be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost data, or business interruption.

9. Indemnification

You agree to indemnify and hold us harmless from any claim, demand, loss, or expense (including reasonable legal fees) brought by any third party arising out of your Content, your use of the Recruit Portal, your handling of applicant data, or your breach of these Terms.

10. Prohibited conduct

Scraping, reverse-engineering, or automated access outside our published APIs;
Posting the same opportunity under multiple listings to game search;
Using JobAds.ca to recruit for opportunities located outside Canada without disclosing this clearly;
Requiring applicants to pay any fee to apply, be considered, or be hired;
Publishing MLM, pyramid-scheme, or "get rich quick" opportunities;
Interfering with the operation of the platform, other users, or applicants.

11. Changes to these Terms

We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top of this page and post the revised Terms here. If the change is material we will make reasonable efforts to notify you by email or by a notice inside the Recruit Portal. Your continued use of the Recruit Portal after a change takes effect constitutes acceptance of the revised Terms.

12. Governing law

These Terms are governed by the laws of the Province of Saskatchewan and the applicable laws of Canada, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Recruit Portal will be brought exclusively in the courts of Saskatchewan, and you consent to their jurisdiction.
